Terms of Service – Website Design
1. Acceptance of Terms
Microsen provides service to you, subject to the following Terms of Service, which may be updated from time to time without notice to you.
2. Description of Service
Microsen currently provides website designs for the Internet. Designs can range from simple Websites to complex multi-page designs. Projects may include but not limited to: graphics, sound files and other miscellaneous web content.
3. Your Obligations
In consideration of use of the Service, you agree to provide complete information about your organization and / or your projected needs as necessary for completion of the specified project, including intent for use of service if necessary. You may not reuse original work provided by this service in any other projects, excepting images depicting or including User’s logo, business name, contact information or employee(s), without prior written consent from Microsen.
4. Disclaimer of Warranties
You expressly understand and agree that: (a) your use of the service is at your sole risk. The service is provided “as is”. (b) The service will be timely, and secure. (c) The quality of any products, service, information, or other material purchased or obtained by you through this service will meet your expectations. (d) Any materials downloaded or otherwise obtained through the use of this service is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the use or download of any such material. (e) No advice or information, whether oral or written, obtained by you from Microsen or through or from this service shall create any warranty not expressly stated in this Terms of Service.
5. Limitation of Liability
You expressly understand and agree that Microsen shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, resulting from use of this service or provided project.
6.Retention of Rights
Unless otherwise specified in writing, Microsen retains rights of ownership of all original work provided by this service, excepting images depicting or including User’s logo, business name, contact information or employee(s). Microsen retains the right to place a trademark or service mark on the home page of this project, or visibly linked documentation page, if applicable. In addition, Microsen retains the right to display and / or demonstrate, in any format, the design, cost and functionality of the project to future prospective clients, or those operating on their behalf, except if such display or demonstration comes into conflict with signed Confidentiality and Non-Disclosure Statement or Mutual Confidentiality and Non-Disclosure Agreement.
7. Acceptance of Service
Upon receiving the final project the user shall: (a) verify accuracy of service and notify Microsen within (15) fifteen calendar days by email (contact@Microsenonline.com) of any changes, if any, that must be completed for final acceptance. (b) if after fifteen days Microsen has not been notified of acceptance or non-acceptance it will be assumed that the user is satisfied with the services provided and will pay Microsen accordingly. (c) Upon acceptance user will pay Microsen within (30) thirty calendar days. Note: days of acceptance will start from one day after completed project has been delivered to the user. For example, if Microsen delivers the project to you on Monday the 14th, then day of acceptance begins on Tuesday the 15th.
8. Basic Service Terms
A) Microsen agrees to the following:
1) Design Website media (pages, banners, etc.)
2) Deliver finished product to customer within two weeks if possible.
3) All items written in attached Service Proposal, if applicable.
B) End User Agrees To:
1) Provide Microsen with all material deemed necessary for website design
2) Pay Microsen upon acceptance of service.
3) Provide a formal Letter of Referral for Microsen upon acceptance of service;
including, but not limited to: User’s needs before use of service, how use of service helped to meet or eliminate those needs, and overall satisfaction rating of services provided.

Signed copies of this document (“Terms Of Service – Web Design”), and the appropriate privacy policy (“Confidentiality and Non-Disclosure Statement”) for individuals, or (“Mutual Confidentiality and Non-Disclosure Agreement”) for bands or small businesses, if applicable, must be on file at Microsen before any services will be rendered. Please print a copy of these documents, sign, and mail completed forms along with Company letter headed order to:
